Terms of Service for HustleWithMe

Please read these Terms of Service ("Terms", "ToS") carefully before using the HustleWithMe application (the "Service") operated by HustleWithMe ("Us", "We", or "Our").

Your access to and use of the Service is conditioned upon Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of the terms, You do not have permission to access the Service.

1. User Accounts

  • 1.1. When You create an Account with Us, You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your Account.
  • 1.2. You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password.

2. User Content and Community Rules

2.1. User Responsibility and Liability (Indemnification)

You are solely responsible for all pictures, emojis, and other content ("User Content") that You upload, post, or share on the Service.

  • You Warrant: By posting User Content, You warrant that You either own the content or have all necessary licenses, rights, consents, and permissions to use and authorize the Company to use the content as necessary to provide the Service.
  • Indemnification: You agree to defend, indemnify, and hold harmless the Company, its owners, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to attorney’s fees) arising from any claim that Your User Content violated the rights of a third party, including copyright, privacy, or defamation rights, or violated any applicable law.

2.2. Prohibited Content and Conduct

The Company reserves the right, but is not obligated, to monitor, review, or remove User Content at its sole discretion, as detailed in our Privacy Policy. You agree not to use the Service to upload, post, or transmit any User Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable under German or EU law.
  • Infringes upon the intellectual property rights of others (including copyright or trademark).
  • Constitutes unauthorized or unsolicited advertising, promotional materials, or any other form of solicitation.
  • Impersonates any person or entity.
  • Contains any software viruses or other harmful computer code.

3. License to User Content

By posting User Content to the Service, You grant Us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute that User Content solely for the purposes of operating and promoting the Service (e.g., storing and delivering content to Your circle).

4. Termination and Suspension (Right to Ban)

We may terminate or suspend Your Account immediately, without prior notice or liability, for any or no reason, including without limitation if You breach these Terms.

  • Upon termination for any reason, Your right to use the Service will immediately cease.
  • If Your account is terminated due to a breach of these Terms, You acknowledge that the Company is under no obligation to refund any associated fees or restore access to Your data.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Service, or the information, content, or materials included therein. You expressly agree that Your use of the Service is at Your sole risk.

6. Limitation of Liability

In no event shall the Company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) Your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any User Content obtained from the Service; and (iv) unauthorized access, use, or alteration of Your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect.
